Terms of Service

These terms govern use of the EWLPS CMC Vetting application (the "Service"), provided by EWLPS ("EWLPS", "we", "us"). By registering an account, you agree to these terms on behalf of the organisation you represent ("you", "your organisation"). If you don't agree, please don't use the Service.

1. Who can use the Service

The Service is intended for Claims Management Companies (CMCs) authorised by the Financial Conduct Authority (FCA) to carry out claims management activity. You confirm that the FCA reference number you provide on registration is accurate and belongs to your organisation. We do not automatically verify this against the FCA Financial Services Register at the point of registration - we may review or spot-check FCA status manually, and we may suspend or close accounts that we find have provided false or misleading information about their FCA authorisation.

One account should be registered per organisation. You're responsible for keeping your login credentials secure and for all activity that happens under your account.

2. What the Service does

The Service lets you submit housing disrepair claim cases, along with supporting information and documents, for AI-assisted vetting against a defined set of criteria. It returns a RED / AMBER / GREEN rating and supporting analysis to help your organisation decide whether to pursue a case.

The output of the Service is decision-support only. It is not legal advice, and it is not a guarantee of case outcome or viability. Your organisation remains solely responsible for the professional and legal judgements it makes about any case, including whether to accept, pursue, or decline it.

3. Tokens and payment

Access to submit vettings is paid for using tokens, purchased in batches. Each vetting submission uses one token. Current packages are:

  • Starter - 10 tokens for £50.00 (£5.00 per vetting)
  • Standard - 25 tokens for £115.00 (£4.60 per vetting)
  • Professional - 50 tokens for £200.00 (£4.00 per vetting)
  • Growth - 75 tokens for £280.00 (£3.73 per vetting)
  • Enterprise - 100 tokens for £350.00 (£3.50 per vetting)

Prices are shown in GBP and include any applicable taxes unless stated otherwise. Payments are processed by Stripe; we don't store your card details. Tokens are non-refundable once a vetting has been submitted and processed, except where required by law. If a vetting fails to process due to a fault on our side, the token used for it will be restored to your balance automatically.

We may change token pricing or package structure from time to time. Changes will apply to purchases made after the change takes effect.

4. Your data and your responsibilities

When you submit a case, you're entering personal data about your own client into the Service. As between you and us, your organisation is the data controller for that data and EWLPS processes it on your instructions, as set out in our Privacy Policy. You confirm that:

  • you have a lawful basis to collect and submit your client's personal data, including any special category data (such as health-related information reflected in a vulnerability flag or a "medical" document upload);
  • you have given your client appropriate information about how their data will be used, including that it will be processed by an AI system as part of vetting; and
  • the information you submit is accurate to the best of your knowledge.

5. Acceptable use

You agree not to:

  • use the Service for any case, client, or purpose you don't have proper authority to act on;
  • attempt to access another organisation's account, data, or documents, or to circumvent access controls;
  • submit fabricated, misleading, or knowingly inaccurate case data;
  • interfere with the operation of the Service, including attempting to overload it or bypass its token or payment mechanisms;
  • use the Service to build a competing product, or resell access to it without our agreement.

We may suspend or terminate accounts that breach this section, or that we reasonably believe are being used fraudulently or unlawfully.

6. Availability

We aim to keep the Service available and operating correctly, but we don't guarantee uninterrupted availability. We may carry out maintenance, and functionality may occasionally be affected by issues with third-party providers we rely on (see our Privacy Policy for the providers we use).

7. Intellectual property

We own the Service, including its software, design, and the vetting criteria and methodology it applies. You retain ownership of the case data you submit. You grant us the licence needed to process that data solely to provide the Service to you.

8. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't lawfully be limited or excluded. Subject to that, the Service is provided on the basis that outputs are decision-support rather than professional advice, and to the fullest extent permitted by law we're not liable for losses arising from decisions your organisation makes based on that output, or for indirect or consequential losses. Our total liability to you in respect of the Service in any 12-month period is limited to the amount you've paid us in that period.

9. Termination

You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate your account for breach of these terms, non-payment, or where we reasonably believe your FCA authorisation has lapsed or was misrepresented. On closure, unused tokens are non-refundable unless required by law.

10. Changes to these terms

We may update these terms from time to time. We'll update the "last updated" date above, and for significant changes we'll let account holders know directly. Continued use of the Service after changes take effect means you accept the updated terms.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them or the Service.
